Effective Date: Upon purchase or activation of subscription services.Welcome to MyTruckManager.com ("MTM"). These Terms of Service ("Terms") govern your use of MTM's dispatch coordination services.By subscribing to MTM services, completing checkout, accessing the MTM platform, or otherwise utilizing MTM services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.If you do not agree to these Terms, you must not use MTM services.

1. Service Overview

MyTruckManager ("MTM") provides independent dispatch coordination and freight communication services to trucking companies, owner-operators, and freight carriers (collectively referred to as "Carriers").MTM functions exclusively as a dispatch service provider and communication facilitator between Carriers and third-party freight brokers, shippers, and load providers.MTM does not operate trucks, transport freight, or provide physical transportation services.MTM services are limited to assisting Carriers with identifying potential freight opportunities and facilitating communication with freight brokers.MTM does not guarantee load placement, freight availability, or revenue outcomes.Freight market conditions are dynamic and depend on numerous external factors beyond MTM's control, including but not limited to:Broker carrier selectionMarket demand for specific equipmentGeographic freight availabilityCarrier equipment specificationsRegulatory requirementsSeasonal freight fluctuationsMTM's services are effort-based dispatch services, not guaranteed freight placement.

2. Scope of Dispatch Services

MTM may provide the following dispatch-related services:• Freight load searches using available load boards and broker networks
• Communication with freight brokers regarding available loads
• Negotiation of load rates and dispatch terms when authorized by the Carrier
• Transmission of load details and rate confirmations to the Carrier
• Assistance coordinating dispatch communication between the Carrier and brokers
• Administrative dispatch support related to freight bookingMTM's responsibilities are strictly limited to dispatch coordination and communication assistance.MTM does not control:Broker load assignments,Freight market availability,Carrier approval by brokersDelivery schedulesCargo handlingDriver performanceTransportation operationsAll transportation services are performed solely by the Carrier.

3. Service Fulfillment Acknowledgment

By subscribing to MTM services, the Carrier acknowledges and agrees that dispatch services begin immediately upon subscription activation.Dispatch services involve both direct communication and substantial operational work conducted by dispatch personnel behind the scenes.Dispatch work performed by MTM may include:• Custom freight searches tailored to the Carrier's truck type, trailer type, dimensions, weight limits, and operating preferences
• Review of freight marketplaces and broker postings
• Broker outreach and communication regarding available loads
• Rate negotiations and verification of load details
• Dispatch coordination communications with the CarrierDispatch personnel may conduct dozens of broker contacts daily, which can include 50–100 phone calls or communications per day in an effort to locate freight opportunities that match the Carrier's specific equipment, location, and scheduling requirements.These operational efforts constitute delivery of the service purchased, regardless of whether a load is ultimately secured.Freight booking depends on external broker approval and market conditions and therefore cannot be guaranteed by MTM.The Carrier acknowledges that dispatch activity itself constitutes service fulfillment.

4. Carrier Responsibilities

The Carrier remains solely responsible for all transportation operations.The Carrier agrees to maintain full compliance with all applicable laws and regulations, including but not limited to:FMCSA regulationsDOT safety standardsFederal and state transportation lawsInsurance requirementsDriver qualification standardsThe Carrier is responsible for maintaining valid:FMCSA operating authority, Liability insurance, Cargo insurance, Driver compliance documentation, The Carrier maintains full operational control over all drivers, vehicles, cargo handling, and delivery operations.

5. Payment Terms

MTM services operate on a subscription-based billing model.By completing checkout, the Carrier authorizes MTM to charge the designated payment method for recurring subscription fees.Subscription payments cover: Dispatch availability, Dispatch labor, Freight search activity, Broker outreach efforts, Dispatch coordination services, Payments compensate MTM for dispatch work performed, not guaranteed load placement.

6. Refund Policy

MTM provides a human-operated dispatch service that requires active labor, time, and operational resources from dispatch personnel.Subscription payments primarily compensate MTM for dispatch work performed, not guaranteed freight bookings.

Refund Eligibility

A refund may only be issued in the limited circumstance where no dispatch activity has occurred on behalf of the Carrier after subscription activation.Dispatch activity includes but is not limited to:

• Direct outreach to the Carrier by MTM dispatch staff
• Phone calls, text messages, or email communication with the Carrier
• Broker outreach or load negotiation attempts
• Custom load searches based on the Carrier's equipment specifications
• Communication regarding load opportunitiesIf no dispatch contact or activity has occurred, the Carrier may submit a refund request.MTM may issue a refund at its sole discretion after reviewing internal dispatch activity records.

Non-Refundable Circumstances

Once MTM dispatch staff has initiated any form of dispatch activity or communication, the service is considered active and fulfilled, and payments become non-refundable.Dispatch services involve substantial operational work conducted by dispatch personnel, including:

• Custom load searches based on truck type, trailer type, dimensions, weight limits, and location
• Monitoring freight marketplaces and broker postings
• Contacting brokers to inquire about freight opportunities
• Negotiating load terms
• Coordinating dispatch communicationsDispatch teams may conduct 20–100 broker contacts per day in an effort to locate appropriate freight opportunities.Because these efforts require significant human labor and operational resources, payments are non-refundable once dispatch work has begun, regardless of whether a load is ultimately secured.

Market Conditions Disclaimer

Freight availability depends on numerous external factors including:Market demandBroker carrier selectionEquipment specificationsLocation and freight lanesSeasonal freight fluctuationsMTM does not guarantee freight volume, load placement, or revenue levels.The service provided is dispatch effort and broker outreach, not guaranteed freight bookings.

Refund Request Procedure

Refund requests must be submitted in writing to:support@mytruckmanager.com

All refund requests are reviewed using internal dispatch activity logs and communication records to determine eligibility.

7. Limitation of Liability

To the fullest extent permitted by law, MTM shall not be liable for any:Indirect damages, Consequential damages, Lost profits, Business interruption, Cargo damage, Delivery delays, Broker disputes, Transportation incidents, MTM's total liability shall never exceed the total subscription fees paid by the Carrier during the previous thirty (30) days.

8. Indemnification

The Carrier agrees to indemnify and hold harmless MTM, its owners, employees, affiliates, and contractors from any claims, liabilities, damages, losses, or expenses arising from:Transportation services performed by the Carrier, Regulatory violations, Cargo loss or damage, Broker disputes, Use of MTM dispatch services

9. No Warranty

MTM services are provided "AS IS" and "AS AVAILABLE."MTM makes no guarantees regarding:Load availability,Broker approvals,Freight volume,Revenue outcomesAll dispatch services are dependent on external third-party factors.

10. Cancellation Policy

Subscriptions automatically renew unless canceled.Cancellation requires written notice at least thirty (30) days in advance.During the notice period:Dispatch services remain active, Subscription fees remain payable.

11. Modification of Terms

MTM reserves the right to update or modify these Terms at any time.Updated Terms will be published on the MTM website.Continued use of MTM services constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts located within Texas.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between MTM and the Carrier regarding MTM services.
