Welcome to MyTruckManager.com ("MTM"). By subscribing, completing checkout, accessing, or otherwise utilizing our services, you hereby expressly consent and agree to comply with and be legally bound by these Terms of Service ("Terms"). Please carefully review these Terms thoroughly and completely before proceeding.

1. Service Description

MTM exclusively provides dispatch coordination and load management communication services to trucking companies, independent truck operators, and freight carriers (collectively, "Carriers"). MTM explicitly disclaims ownership, management, operational control, or direct provision of any transportation or logistics services.

2. Scope of Services

MTM functions solely as an intermediary communication facilitator between Carriers and third-party freight brokers, shippers, or load providers. MTM’s responsibilities explicitly include:

  • Providing dispatch information, load assignment notifications, and communication facilitation.

  • Coordinating and facilitating load bookings strictly according to explicit instructions and approvals provided by Carriers.

MTM expressly excludes responsibility for:

  • The actual provision, guarantee, or physical execution of transportation services.

  • Liability concerning cargo handling, security, accuracy of load details, shipping compliance, delivery timelines, transit delays, cargo loss, theft, or damage.

3. Limitation of Liability

By subscribing to or completing checkout for MTM services, you explicitly acknowledge and irrevocably agree that:

  • MTM shall bear NO liability whatsoever for any direct, indirect, incidental, consequential, punitive, special, or exemplary damages or losses including, without limitation, claims arising from lost profits, business interruption, delays, cargo damage, theft, accidents, injuries, or any transportation-related incidents.

  • MTM's maximum cumulative liability, in any event, shall never exceed the total amount paid by you to MTM during the preceding month.

4. Carrier Responsibilities

You explicitly affirm and irrevocably warrant that you:

  • Maintain sole and exclusive responsibility for full compliance with all applicable federal, state, and local transportation laws, DOT regulations, FMCSA regulations, insurance requirements, and all applicable safety and legal standards.

  • Are solely and exclusively responsible for procuring, maintaining, and verifying adequate and valid insurance coverage (including liability, cargo, and other insurance requirements) for your equipment, drivers, operations, cargo, and all related transport activities.

  • Accept and bear full liability and accountability for your employees, contractors, drivers, vehicles, cargo handling, shipping documentation, and all operational and logistical activities.

5. Indemnification

You irrevocably and unconditionally agree to indemnify, defend, and hold harmless MTM, its affiliates, directors, officers, employees, representatives, subcontractors, successors, and agents from any claims, lawsuits, demands, liabilities, damages, penalties, fines, losses, costs, expenses, and attorney’s fees arising from, relating to, or connected with your use of MTM services, your operations, regulatory compliance, cargo handling, delivery performance, or violations of these Terms.

6. No Warranty

MTM explicitly and unequivocally disclaims any and all warranties, guarantees, or representations, express or implied, regarding its services, including but not limited to warranties of merchantability, fitness for a particular purpose, timeliness, accuracy, completeness, reliability, security, or non-infringement. MTM services are provided strictly "AS IS" and "AS AVAILABLE."

7. Subscription Terms and Cancellation Policy

All subscriptions are strictly non-refundable and automatically renew unless explicitly canceled through written notification. Upon completion of subscription checkout, you authorize MTM to automatically debit your designated payment method for recurring subscription fees.

Cancellation requests must be submitted in writing and require a minimum of thirty (30) days' advance notice. During this thirty (30)-day notice period, Carriers remain responsible and obligated to pay all outstanding subscription fees and charges due or accruing within that notice period. This mandatory notice period policy is essential for MTM to maintain cost efficiency and effectively manage operational stability and client turnover.

8. Modification of Terms

MTM reserves the unequivocal right to amend, revise, modify, or update these Terms at any time and at its sole discretion. Revised Terms will be promptly published on our official website. Your continued access or use of MTM services following the publication of modified Terms constitutes your binding acceptance and explicit consent to such revised Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed exclusively by, interpreted, and enforced in accordance with the laws of the State of Texas. You expressly consent and submit to the exclusive jurisdiction and venue of the competent courts situated within the State of Texas for resolution of any and all disputes, controversies, claims, or proceedings arising out of or in connection with these Terms or MTM services.

10. Entire Agreement

These Terms constitute the complete, comprehensive, and exclusive agreement between you and MTM concerning your use of MTM services, fully superseding any and all previous communications, understandings, negotiations, or agreements, whether oral, written, or electronic.

11. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by any court of competent jurisdiction, such invalidity or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.
